These Terms of Service ("Terms") govern your access to and use of the website located at https://qk.coffee (the "Site"), including any online store, account features, and related services (collectively, the "Services") operated by ALL AMERICAN COFFEE LLC, a Florida limited liability company ("Company," "we," "us," or "our"), with its principal place of business at 61 NE 683rd Street, Old Town, Florida 32680, USA. QuicKafe™ is a trademark owned by ALL AMERICAN COFFEE LLC.
By accessing or using the Site or Services, creating an account, placing an order (whether as a consumer or business customer), or clicking "I Agree" or similar, you ("you" or "Customer") agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Site or Services.
We may update these Terms from time to time. The "Last Updated" date will change, and continued use after posting constitutes acceptance of the revised Terms. Material changes will be highlighted where practicable.
You must be at least 18 years old and have the legal capacity to enter into a binding contract. By using the Services, you represent that you meet these requirements. The Services are intended for use in the United States. We do not knowingly sell to persons under 18 or to residents of jurisdictions where our products are prohibited.
For Business-to-Business (B2B) accounts, you represent that you are authorized to bind the business entity you represent.
Certain features require an account. You agree to provide accurate, current, and complete information and to keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately of any unauthorized use.
We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our discretion.
We offer premium liquid coffee and tea concentrates (the "Products") under the QuicKafe™ trademark. Product descriptions, images, flavors (including Original, French Vanilla, Hazelnut, Irish Cream, Decaf Swiss Water® Process, and any tea varieties), dilution ratios, shelf-life information, and nutritional details are provided for informational purposes and are believed accurate at the time of posting. We do not warrant that descriptions are error-free, complete, or current.
Products are food items. Always follow the preparation, dilution, storage, and usage instructions on the label or Site. Refrigerate after opening as directed. Products contain caffeine (except designated decaf) and may contain allergens — review labels carefully. We make no medical, health, or therapeutic claims.
We reserve the right to limit quantities, discontinue Products, or correct pricing or description errors at any time.
All orders are offers to purchase subject to our acceptance. We may refuse or cancel any order for any reason, including suspected fraud, inventory issues, or pricing errors.
Prices are listed in U.S. dollars and are subject to change without notice. Applicable sales tax, shipping, and handling will be added at checkout. For B2B wholesale orders, additional volume pricing, minimum order quantities, or net terms may be available subject to credit approval and as separately agreed in writing.
Payment is due at the time of order via PayPal and related payment methods including cards, Venmo, and Apple Pay, processed by third-party providers. You authorize us to charge the payment method provided. For approved B2B accounts, invoicing and net terms may be available subject to credit approval and separate written agreement.
We ship within the United States (and selected territories if indicated). Shipping costs, methods, and estimated times are shown at checkout. Title and risk of loss pass to you upon our delivery to the carrier.
Delivery times are estimates only. We are not liable for delays caused by carriers, weather, customs, or events beyond our reasonable control. For temperature-sensitive concentrates, we take reasonable packaging steps, but you are responsible for prompt retrieval and proper storage upon delivery.
International shipping, if offered, is subject to additional terms, duties, and restrictions.
Consumer (DTC) orders: If you are not satisfied, contact us within 15 days of delivery for a return authorization. Unopened Products in original condition may be eligible for a full refund of the product price (excluding shipping) at our discretion. Opened or used Products are generally non-returnable except for verified defects. Defective or incorrect items will be replaced or refunded upon verification.
B2B orders: Returns are limited to defective or non-conforming Products reported within 7 days of delivery, subject to our inspection and written authorization. No returns of opened or partially used bulk product without prior written approval.
To initiate a return, contact us using the details in Section 17 with your order number and reason. Unauthorized returns will not be accepted. Refunds, if approved, will be issued to the original payment method within a reasonable time.
All content on the Site — including text, graphics, logos, trademarks (QuicKafe™ and related marks), product images, and software — is owned by us or our licensors and protected by U.S. and international intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.
You may not use our trademarks in any manner that suggests endorsement or affiliation without permission.
The Site may allow you to submit, post, or display content, including product reviews, comments, ratings, photos, or other materials ("User Content").
You retain ownership of your User Content. By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such User Content (including your first name or username) in connection with the Site and our business, in any media now known or later developed.
You represent and warrant that:
We reserve the right (but not the obligation) to moderate, edit, refuse, or remove any User Content for any reason, including violation of these Terms. We are not responsible for User Content submitted by others.

THE SITE, SERVICES, AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT PRODUCTS WILL MEET YOUR EXPECTATIONS.
Some jurisdictions do not allow the exclusion of certain warranties; in such cases, the above exclusions apply to the fullest extent permitted by law.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE (AND OUR OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING LOST PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THESE TERMS, THE SITE, OR PRODUCTS, REGARDLESS OF THE THEORY OF LIABILITY.
OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SPECIFIC PRODUCT(S) GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
These limitations apply even if we have been advised of the possibility of such damages.
You agree to indemnify, defend, and hold harmless the Company and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Site or Products; (b) your violation of these Terms; (c) your violation of any third-party rights; (d) any User Content you submit; or (e) any content or information you provide.
Your use of the Services is also governed by our Privacy Policy. By using the Services, you consent to the collection, use, and sharing of information as described therein. Note that product reviews and associated first names or usernames are displayed publicly on the Site.
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.
Arbitration is the exclusive method of dispute resolution, except as expressly provided below. Any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or the Services shall be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA").
The arbitration shall be conducted on an individual basis only. Class actions, class arbitrations, and jury trials are waived to the fullest extent permitted by law. Judgment on the arbitration award may be entered in any court of competent jurisdiction.
Exceptions / carve-outs: Either party may seek temporary, preliminary, or permanent injunctive or other equitable relief in court solely for intellectual-property infringement, unauthorized use of trademarks, or other matters requiring immediate equitable relief. Either party may also bring an action in court to enforce an arbitration award. For any such court proceedings, the exclusive venue shall be the state or federal courts located in Dixie County, Florida, and you consent to personal jurisdiction and venue there.
This arbitration provision survives termination of these Terms.
We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, your right to use the Services ceases immediately. Sections that by their nature should survive (including 7–14, 16, and 17) will survive.
